Someone took a picture of my son at a family gathering and posted it on their myspace account. They did this before and we found out through a freind. We then made a big deal of this and they finally took it off. Well they have gone and done it again without our permission. What legal grounds to we have to have this removed, I know it is not copyright infringement, but what else would it be. We have been in contact with my space for over two weeks now and they seem to be of no help.Is it illegal to post a picture of a minor without the parents consent on myspace?
I believe the only thing you can do about it is to ask them to remove it and ask that they no longer post pictures of your child. They can set their photos to private and they would be the only ones able to view it. This is an option if they don't want to remove it completely. But usually the point of posting them is to let all of your friends see them. If they have simply posted a photo with no malicious content, they are legitimately allowed to do so.

There is a new law now where Child Enforcement Agencies are charging a $25 a year fee, not to the ones that owe child support, but to the custodial parent who is OWED child support...that when the non cust. parent sends in a payment, a fee is taken out and guess where it goes? There is a lot more to this, but the non custodial parent does have a COURT ORDERED visitation guide, and has NEVER done anything to harm, (in any fashion) this child. The child has the right to refuse to go, but if there is contention between the parents, then the non custodial parent will see the child refusing to go as the child having been influenced by the custodial parent--not because of anything the child actually wants.
The non-custodial parent will have the right to call the police in to have the child forcibly removed from the custodial home, but if the child is able to convince the police that he has a legitimate reason for not wanting to go with the parent, then they may not force the child to go.
But before things get that far, the child is old enough to sit down with the non-custodial parent and explain why he doesn't want to visit at this time. The child is at an age when his social life picks up (I'm going to assume that this is why the child doesn't want to visit) and he and his parent need to negotiate between themselves how they are going to handle their time together. It needs to be made clear to the child, that since his time with his non-custodial parent is limited and his parent wants to spend time with him, that he needs to make an effort to call during the week-just to talk (5-10 minutes of idle chit chat) and to arrange his social calendar around his visitation times or when he can't, to negotiate an alternative visitation time with his parent.
If the reason the child doesn't want to visit doesn't have anything to do with his social life, then a better effort by the parent needs to be made to find out why the child doesn't want to go. Is there someone else at the non-custodial parent's home who is making life difficult for the child? Is the custodial parent saying things, not specifically to the child but around the child that causes the child to feel like he has to choose between his parents?
If the child isn't forthcoming about why he doesn't want to go and the custodial parent is not helping to figure out what the issues are, then this is when you need to go back to court on the custody issue and have social services get involved to interview the child to see what the real issue is. Please note that this is a drastic and serious turn which would indicate there are some serious issuses going on.

If you call the police, they will follow the divorce decree visitation schedule.

In Texas the police can not force a 15 year old to go. I also, as a 17 year veteran officer would not allow the child to be forced, physically, by either parent to go. I have had dozens of consultations with different assistant district attorneys about this. You should have audio and video of the confrontation to defend against a contempt of court hearing if you are the custodial parent. I do not think a judge would find contempt though. I would attempt counseling as a family, with both parents. If there is no history of trouble the custodial parent should do everything possible to encourage the child to go. Remember that laws vary state to state, but I doubt any state would allow a child that old to be dragged kicking and screaming against their will.

The kid should be encouraged to maintain some contact with the noncustodial parent. It doesn't sound like the family dynamics involved the non custodial parent as being abusive so the kid should show RESPECT to the parent that did help create it by keeping in contact with the parent. (Christmas and birthday card and copies of the report cards and a school photo each year would be a decent offering).
Family is family and the kid should be taught to understand that.
Hello,,the child can refuse to visit for whatever reason, even out of spite, cannot force the issue , and cannot take the child using force, only time can make it work and that's the truth about being the non-custodial parent, fact is I have a 13 yr old son that just decided to quit coming over after spending every weekend for 3 years with me, his dad, he got upset with me stopping the spending of bunches of money on fun things and decided to stay at home, no supervision, his mom would lock the door and not allow him to go outside but just play video games and watch tv, and computer time, I was not allowed to see him all summer, I took days of for every weekend scheduled to be with him and it meant nothing, when I wrote to the Governor of OHIO,Ted Strickland%26lt; he responded by referring me to the Child ands job services , they said they had no jurisdiction over the local court system and when I wrote to the OHIO supreme court to try and see if some kind of law could be made for the children of divorced or seperated, and/ or not married but with children, because my ex was arrested for drunk driving with my son with her,I still have no idea who or where my son was put while she was arrested and locked up!! I was pushing for a child safety law, reversing the custody of the child to the significant other parent, why let some drunken drug convicted parent have the child and fill their head full of lies about the way to hide their problems from the schools and families who love them I was never responded by this legal systems rep., so as long as you pay your support and vote for the lying pricks you are doing what they want, good luck and pray some of them hit a tree while spending tax money on their life styles of not helping the american children who are at risk of losing the country to foreign investors.

What is a cute way to announce a pregnancy to your parents and in-laws?
My sister just told me she is pregnant with her first baby and she wants a cute way to tell our parents and her in-laws. This will be a first grandchild for her in-laws. We are going to go to the Mall to The Build A Bear workshop and get a few of those voice recorders you can put in the bear so when you press the bears tummy you hear something. Well at my next doctors appointment we are going to record our babys heartbeat then go back to mall and pick out a few bears and put the recorders inside so when they press the bears tummy they can hear there grandchilds heart beating. I think it's a very cute idea.
How about an ornament or some type of Christmas decoration that says Baby's First Christmas. After all, the baby will definitely be there! lol.
Have her buy them each a keepsake item (quilt, picture frame, photo album) and have them engraved or stiched to say ';To Grandma and Grandpa'; and see how long it take them to get it..
Maybe get them something that says 'worlds best grandparents' or something similar. I think it would be cute to see their faces after they open it!

I appreciate how my parents raised me. i'm allowed to go out with my friends when i want (just as long as i let them know who, what, when, where, and why. but i have a curfew and make sure i stick with it so i won't lose that privilege), I'm a solid Christian, well-disciplined with a job, and my parents TRUST me. i don't mind them searching my computer or my room, because I DON'T HAVE ANYTHING TO HIDE. i know they love me and i will raise my kids the same.

If you want to get it at a place that doesnt ask for consent Their garbage and you will probably get a backwoods screwed up infected piercing. It's against the law quite litterally. So try to convince mom or dad to help you out and work for it. I begged from 13 to 16 for a tongue piercing and mom said no. Thank god I would have regretted it immensly. I got my first piercing when I was 17 three weeks before my 18th birthday and It was good I waited till mom agreeed. Do your research know your piercing and everything that can go wrong and your statistics it will help your argument immensly

I wish for the opposite of ruining my kids' lives. I want them to have a better life than me! However, what you may not understand is that parents very much wish that their kids could learn from the parents' experience, rather than having to go through their own failures. But when we try to tell you what is best, rather than thanking us and following our experience-aided advice, you reject it and mislabel it as an attempt to ruin your life. This dynamic sucks for both sides, actually. Why do you think parents wish to ruin their childrens lives for?
of course not. they do wish to keep their children healthy, wealthy and wise. this may not be what is actually in the child's best interest in the long run but the formative years are for parents to assert what they think is the best plan. after age 18 a child may effectively decide to do what they wish, as long as they also choose to accept no funds. if you take the money, you usually also have to take the advice.

Then those teenagers go out into the real world, have to pay the bills and make their own decisions and they find it is not as easy as it looked thought their eyes when they were younger. Then they have children of their own and their whole viewpoint changes.
I hated my mum and dad for not letting me do things I wanted to do, then I became a parent and I realised how hard it really was and the cycle continues.
.........and then there is some people who just blame others for their own mistakes, because it is easier to blame someone else than take responsibility for the mistakes themselves.

My cousins parents tried so hard to make her the smartest, prettiest, most responsible daughter ever. She went to college 2 years early, and halfway through her first year, she became out of control. She wasnt used to the freedom and option to make her own choices, and didnt have the skills to do things on her own, without being told. It eventually developed into her getting into a violent relationship with a man that dictated her every move...and due to the control over her at home, she thought that was normal. Since then I've 'adopted' her and shes getting back on track, but at 20 years old, she still isnt 'adult' enough to make basic decisions on her own.
Not that I'm saying all cases are like that. Just one example of thousands.
Edit: That came out sounding more negative then I had hoped. Basically what I was trying to say is that parents try to prevent their children from making the same mistakes they did, but sometimes you have to learn the biggest life lessons on your own. Hopefully that sounds better.

I am a sinlge parent and just applied for a small college. I was able to get a pell grant and student loans but stiol have a balance. I cant afford to pay the balance or even pay abck the student loans. I was told by many perople since I am very low income and a single parent i can get my schooling paid for. I just dont know how to do it. It actually showed that it may be more damaging. If you feel that your son is not getting the education that he needs then find him a different school but complaining incessantly about something as silly as this is going to get him nowhere. If you really want to help him teach him more stuff at home AFTER school.

However, what you may not understand is that parents very much wish that their kids could learn from the parents' experience, rather than having to go through their own failures. But when we try to tell you what is best, rather than thanking us and following our experience-aided advice, you reject it and mislabel it as an attempt to ruin your life. This dynamic sucks for both sides, actually. Why do you think parents wish to ruin their childrens lives for?
of course not. they do wish to keep their children healthy, wealthy and wise. this may not be what is actually in the child's best interest in the long run but the formative years are for parents to assert what they think is the best plan. after age 18 a child may effectively decide to do what they wish, as long as they also choose to accept no funds. if you take the money, you usually also have to take the advice.

Oh parents make mistakes ( they are only human) and some children will not forgive them for those mistakes, however little they may be and will continue the unforgiving nature for years, until they find themselves in a similar position with heir own children-then they realise their own parents difficulty.
When children are very young they think parents can do anything, then as they get older they realise their parents can make mistakes and this is a natural disappointment to them, then they become teenagers and think they are old enough to make decisions for themselves, believing their parents are 'stopping them having fun' or just 'don't understand them'.
Then those teenagers go out into the real world, have to pay the bills and make their own decisions and they find it is not as easy as it looked thought their eyes when they were younger. Then they have children of their own and their whole viewpoint changes.
I hated my mum and dad for not letting me do things I wanted to do, then I became a parent and I realised how hard it really was and the cycle continues.
.........and then there is some people who just blame others for their own mistakes, because it is easier to blame someone else than take responsibility for the mistakes themselves.
I dont so much think they do it on purpose, although I'm sure some do.
I think some parents try so hard to do right by their kids, that they become overbearing and demanding, without realizing it.
My cousins parents tried so hard to make her the smartest, prettiest, most responsible daughter ever. She went to college 2 years early, and halfway through her first year, she became out of control. She wasnt used to the freedom and option to make her own choices, and didnt have the skills to do things on her own, without being told. It eventually developed into her getting into a violent relationship with a man that dictated her every move...and due to the control over her at home, she thought that was normal. Since then I've 'adopted' her and shes getting back on track, but at 20 years old, she still isnt 'adult' enough to make basic decisions on her own.
Not that I'm saying all cases are like that. Just one example of thousands.
Edit: That came out sounding more negative then I had hoped. Basically what I was trying to say is that parents try to prevent their children from making the same mistakes they did, but sometimes you have to learn the biggest life lessons on your own. Hopefully that sounds better.

I am a sinlge parent and just applied for a small college. I was able to get a pell grant and student loans but stiol have a balance. I cant afford to pay the balance or even pay abck the student loans. I was told by many perople since I am very low income and a single parent i can get my schooling paid for. I just dont know how to do it. It actually showed that it may be more damaging. If you feel that your son is not getting the education that he needs then find him a different school but complaining incessantly about something as silly as this is going to get him nowhere. If you really want to help him teach him more stuff at home AFTER school.

I care for my disabled 76 yr old father who has lost his leg due to diabetes and has dementia. I often get overwhelmed. He just got out of the hospital and now I have to give him IV meds (well the nurse starts it and I take it off and flush it)

Yes, there is a whole bunch of us family dedicated, responsible people out there. My dad was first and now it's my mom to care for with the Alzheimer. She was never a mean person 'till this came to her. It is stressful but can be offset with talking about the fun stuff that happened years ago even if they do not remember......it's conversation about happy times no matter how many times we repeat it. Don't make yourself miserable doing this job, chill-out, it's just a duty to be performed as only to be expected....and we are not perfect so don't strive for that super level. There is one thing I have come to realize. 'We are born once and in diapers twice'. I've even had my parents laughing over this as it is now my turn to change theirs as they did for me. Arrange a little time for yourself and good luck to you.
Reserve your brother for duty when YOU want to go social or just want time for yourself. Find a support group and find out who the others use for respite care. You need a home health care worker too. Check the white pages for senior service's in your area.

I feel you. My mom and I took care of both my grandparents that had Alzheimer's. My grandma lived with us. It was a very stressful time for the whole family. The best thing to do is to make time for yourself and get away every now and than. It is so hard to care for these people and outside nurses cost a fortune. I swear my grandma went so crazy she would actually try to murder us in our sleep! Finally, when my son was a baby we had to put grandma chair in the corner and build a wooden gate just to make sure she didn't try to kill my newborn! My grandma was looking for him one day to cook him and was going to put him in the oven! NO JOKE! It is so sad to see your loved ones go insane. My grandma was the sweetest person I ever have known. If she would have seen how crazy she got... and knew she wanted to have her great- grandchild for dinner, she would have killed herself! Some days we laughed... most days we cried. My grandma never cussed until she went crazy...than she said words I didn't even know! One day she was screaming in the living room..';Help me, Help me they are going to kill me!'; The mail man heard it and called the cops...a few minutes later the cops came to the door with guns and sheilds. They understood after we explained she was crazy. Just get out go to a movie, dinner or shopping and don't be too hard on yourself. My mom now has a living will stating that my sister and I are not to ever care for her if she is not in her right mind. I know she is doing this out of love for us because she does not want to put my sis and I through it with her, so it is her way of freeing us from the guilt as not to have us be burdened with that kind of responsibility. The following factors to be considered, evaluated, and used by the court to determine what is in the ';best interests'; of the children when establishing a child custody order: (a) The love, affection, and other emotional ties existing between the parties involved and the child. (b) The capacity and disposition of the parties involved to give the child love, affection, and guidance and to continue the education and raising of the child in his or her religion or creed, if any. (c) The capacity and disposition of the parties involved to provide the child with food, clothing, medical care or other remedial care recognized and permitted under the laws of this state in place of medical care, and other material needs. (d) The length of time the child has lived in a stable, satisfactory environment, and the desirability of maintaining continuity. (e) The permanence, as a family unit, of the existing or proposed custodial home or homes. (f) The moral fitness of the parties involved. (g) The mental and physical health of the parties involved. (h) The home, school, and community record of the child. (i) The reasonable preference of the child, if the court considers the child to be of sufficient age to express preference. (j) The willingness and ability of each of the parties to facilitate and encourage a close and continuing parent-child relationship between the child and the other parent or the child and the parents. Stability in their life is more important, next week the kid could want to move again, round and round and courts do not put up with that mentality or proceedings.

You need to be aware of their likes and their dislikes, you have to observe them and know what they like doing and what they engage in and adjust your style of teaching to fit in with their style of learning, otherwise it's meaningless to them. I feel we need to involve parents and update them as much as possible as they want the best for their child and we definitely need to build up a GOOD relationship, but at the end of the day, it is purely professional. You wouldn't say things like, ';Oh, I absolutely adore your daughter, I just want to take her home with me!'; Or something similar, which isn't meant to be taken seriously and should be sweet and a bit of fun because we're professionals. However, the relationship between teacher and child is close and genuine and one of trust and honesty with the child.

I feel we need to involve parents and update them as much as possible as they want the best for their child and we definitely need to build up a GOOD relationship, but at the end of the day, it is purely professional. You wouldn't say things like, ';Oh, I absolutely adore your daughter, I just want to take her home with me!'; Or something similar, which isn't meant to be taken seriously and should be sweet and a bit of fun because we're professionals. However, the relationship between teacher and child is close and genuine and one of trust and honesty with the child.
personally, I feel that the teacher/child relationship is more important. I work in a child care facility where the children are dropped off by sitters, aunts, even grandparents. Since my shift ends before pick up time, I rarely see a parent.

This punishment is great and works for any age. That is, provided they were raised well. If they were raised poorly, then they'll just talk back no matter what punishment you give.
And example of this working even with teens was way back when, when I worked at summer camp as a councellor (when I was 17), I had campers who were 16, and I could make them go stand in the corner and they would do it and it would be so embarassing that they wouldn't commit the same crime again.

Why don't my parents congratulate me for doing good in college?
I have been getting A's in college, but in high school I used to get really bad grades. My parents have always told me to work hard but when I actually do work hard they don't say anything positive. I don't know how to please them because I am doing what they want me to do. It makes feel angry and sad.Why don't my parents congratulate me for doing good in college?
You're not a kid anymore. Maybe they don't think you're so insecure that they need to prop you up with fluffy compliments. Most the time it is the parents that have a hard time adjusting to their kids becoming adults, but in your case it sounds like it's the other way around.
Or, some people are good at criticizing and bad at complimenting. Maybe that's how your parents are.
Also, you SHOULD be doing well for yourself, and in a selfish way! There is no other way to take care of yourself. Selfish means acting in your own self interest. I don't know what your majoring in but I would say just keep doing what your doing and don't worry about pleasing your parents. Just think about yourself but in a non-selfish way I guess. It's cool that you care what your parents think...its better than other kids that could care less you know? So good luck hang in there and when you get out hopefully the job market will be in your favor.
