Is it illegal to post a picture of a minor without the parents consent on myspace?

Someone took a picture of my son at a family gathering and posted it on their myspace account. They did this before and we found out through a freind. We then made a big deal of this and they finally took it off. Well they have gone and done it again without our permission. What legal grounds to we have to have this removed, I know it is not copyright infringement, but what else would it be. We have been in contact with my space for over two weeks now and they seem to be of no help.Is it illegal to post a picture of a minor without the parents consent on myspace?
I believe the only thing you can do about it is to ask them to remove it and ask that they no longer post pictures of your child. They can set their photos to private and they would be the only ones able to view it. This is an option if they don't want to remove it completely. But usually the point of posting them is to let all of your friends see them. If it is a big deal to you, then make it a big deal to your friend.Is it illegal to post a picture of a minor without the parents consent on myspace?
If they have simply posted a photo with no malicious content, they are legitimately allowed to do so.


Good, but unnecessary, of them to respect your wishes.
