Is it illegal to post a picture of a minor without the parents consent on myspace?

Someone took a picture of my son at a family gathering and posted it on their myspace account. They did this before and we found out through a freind. We then made a big deal of this and they finally took it off. Well they have gone and done it again without our permission. What legal grounds to we have to have this removed, I know it is not copyright infringement, but what else would it be. We have been in contact with my space for over two weeks now and they seem to be of no help.Is it illegal to post a picture of a minor without the parents consent on myspace?
I believe the only thing you can do about it is to ask them to remove it and ask that they no longer post pictures of your child. They can set their photos to private and they would be the only ones able to view it. This is an option if they don't want to remove it completely. But usually the point of posting them is to let all of your friends see them. If they have simply posted a photo with no malicious content, they are legitimately allowed to do so.

Are you asking if you can be the reverse mortgage lender? Not if you are not a legal bank you can't.

it wouldn;t be a reverse mortgage, it could just be a private mortgage payable to them instead of to a mortgage company - to actually ';buy the house, you still need to go thru the legal process, which would entail real estate transfer taxes, closing paperwork, transferring everything to you - just get a real estate lawyer - much cheaper than a real estate agent -= get an official, legal mortgage drawn up to protect both of you - they will have to claim income on the mortgage interest income and you can deduct it - if you want the tax deductions - I think they have to declare the income - talk to a lawyer or CPA
You could buy the house from them, you get a regular mortgage on it, and you pay them money monthly for their upkeep. But if you buy the house from them, they could put the proceeds into something safe like a money market fund or CD's, and take interest monthly from that.





If they take out a reverse mortgage, they have basically sold the property to the lender, so no you couldn't buy it from them
You might also consider various types of trusts. Check with a financial planner or estate attorney.





A land trust is one version. In that case, your parents would move the property into their land trust. You'd be added as a beneficiary. The house now would be owned by a trustee. No. You can buy your parents house if you want to but I do not think that you can do it as a ';reverse mortgage';. Where would you get the cash from to give them? A lender will not provide financing for this.

    There is a new law now where Child Enforcement Agencies are charging a $25 a year fee, not to the ones that owe child support, but to the custodial parent who is OWED child support...that when the non cust. parent sends in a payment, a fee is taken out and guess where it goes?     I think that it makes sense on some level, and in a perfect world. I mean, a lot of parents don't want to do their own dirty work of collecting money. This is not meant to be a generalization. I KNOW that there are plenty of parents that wouldn't get a dime even if the cried blood, and pulled teeth. But there are plenty others that don't want to lift a finger and still expect to get something for their kids every month.





    It is not easy, but it is for the child so why not go to bat for them. I think the original intent behind the fee was to convince parents that were otherwise able to collect outside of the system, to take advantage of that. And to save the system for those that really needed it in order to get anything. That plan of course would only work in a perfect world where there was enough man-power to determine who really did need it and who didn't. There is a lot more to this, but the non custodial parent does have a COURT ORDERED visitation guide, and has NEVER done anything to harm, (in any fashion) this child.     The child has the right to refuse to go, but if there is contention between the parents, then the non custodial parent will see the child refusing to go as the child having been influenced by the custodial parent--not because of anything the child actually wants.





    The non-custodial parent will have the right to call the police in to have the child forcibly removed from the custodial home, but if the child is able to convince the police that he has a legitimate reason for not wanting to go with the parent, then they may not force the child to go.





    But before things get that far, the child is old enough to sit down with the non-custodial parent and explain why he doesn't want to visit at this time. The child is at an age when his social life picks up (I'm going to assume that this is why the child doesn't want to visit) and he and his parent need to negotiate between themselves how they are going to handle their time together. It needs to be made clear to the child, that since his time with his non-custodial parent is limited and his parent wants to spend time with him, that he needs to make an effort to call during the week-just to talk (5-10 minutes of idle chit chat) and to arrange his social calendar around his visitation times or when he can't, to negotiate an alternative visitation time with his parent.








    If the reason the child doesn't want to visit doesn't have anything to do with his social life, then a better effort by the parent needs to be made to find out why the child doesn't want to go. Is there someone else at the non-custodial parent's home who is making life difficult for the child? Is the custodial parent saying things, not specifically to the child but around the child that causes the child to feel like he has to choose between his parents?





    If the child isn't forthcoming about why he doesn't want to go and the custodial parent is not helping to figure out what the issues are, then this is when you need to go back to court on the custody issue and have social services get involved to interview the child to see what the real issue is. Please note that this is a drastic and serious turn which would indicate there are some serious issuses going on.

    You need the advice of an attorney or a social worker. Find out for the child's sake.
    No the child can not be forced by the non custodial parent but the custodial parent can be found in contempt of court for failing to surrender the child for visitation.


    If you call the police, they will follow the divorce decree visitation schedule.

    In Texas the police can not force a 15 year old to go. I also, as a 17 year veteran officer would not allow the child to be forced, physically, by either parent to go. I have had dozens of consultations with different assistant district attorneys about this. You should have audio and video of the confrontation to defend against a contempt of court hearing if you are the custodial parent. I do not think a judge would find contempt though. I would attempt counseling as a family, with both parents. If there is no history of trouble the custodial parent should do everything possible to encourage the child to go. Remember that laws vary state to state, but I doubt any state would allow a child that old to be dragged kicking and screaming against their will.

    If the non custodial parent makes a stink over the kid not wanting to visit then simply go back to court and have the custody agreement modified. The kid is old enough that the court will listen to the child's wishes and MOST likely side with the kid.





    By 15 yrs alot of kids are so consumed with hanging with their friends that their parents become like a background noise. Its part of them spreading their wings but it can still hurt to watch them do it.





    The kid should be encouraged to maintain some contact with the noncustodial parent. It doesn't sound like the family dynamics involved the non custodial parent as being abusive so the kid should show RESPECT to the parent that did help create it by keeping in contact with the parent. (Christmas and birthday card and copies of the report cards and a school photo each year would be a decent offering).

    My sister just told me she is pregnant with her first baby and she wants a cute way to tell our parents and her in-laws. This will be a first grandchild for her in-laws.     wrap them each up a bib or something that says something like ';Grandma's girl!'; or ';i love grandpa!'; on it, and give it to them as a christmas present. they will surely get the hint on christmas morning!

    Well I'm 14 weeks pregnant and everyone already knows we are having a baby but we are going to do for a christmas gift would be a great idea for your sister.





    We are going to go to the Mall to The Build A Bear workshop and get a few of those voice recorders you can put in the bear so when you press the bears tummy you hear something. Well at my next doctors appointment we are going to record our babys heartbeat then go back to mall and pick out a few bears and put the recorders inside so when they press the bears tummy they can hear there grandchilds heart beating. I think it's a very cute idea.
    How about an ornament or some type of Christmas decoration that says Baby's First Christmas. After all, the baby will definitely be there! lol.
    Have her buy them each a keepsake item (quilt, picture frame, photo album) and have them engraved or stiched to say ';To Grandma and Grandpa'; and see how long it take them to get it..
    Maybe get them something that says 'worlds best grandparents' or something similar. I think it would be cute to see their faces after they open it!

    Or do like my sister did. Put a diaper in their hand and see if they can figure it out.
    We sent the ultrasound pictures in a baby bottle to my parents and in-laws. They thought that was great.
    ok how about if you make a photo frame and write soomething like '; so and so will become grandparents on.... and write your due date'; and put the pic of your ultrasound there.
    We wrapped the positive pregnancy stick on top of a grandparents' bib. The excitement and shock was perfect on my parent's face. Best to your sister.
    Get a sonogram picture and put it in a big box then wrap it up really pretty and put a giant bow on it. Label it to the parents. and then give it to them for Christmas or Hanukkah

    I'd get them new Christmas stockings that say ';Grandma'; and ';Grandpa';. Also, a picture of the ultrasound in a card is a good one too!

    We bought small baby picture frames and put the due date inside. We then wrapped them and gave them to our parents in an Easter basket. (It was Easter).


    Since the announcement is happening over Christmas, you could put frames in a stocking or set the frames out as place markers at the Christmas dinner table.


    This was fun, as it took a few minutes for our parents to understand the message- They were thrilled!

    I dont really like the idea. I think that your taking away a parents right to discipline their child. Legislating how we raise our children in small issues can grow to be a lot larger I am not comfortable with the government in any for telling me how to raise my kids.
    It sounds a little like the Hitler Youth program, which tried to break down the family unit in favor of loyalty to the state. There is a point where the state can and should intrude, but spanking doesn't cross that line in my opinion.

    i'm 16 years old and was spanked as a child (my mom still tells me that i'm not too old). i was 12 the last spanking (haven't gotten in trouble since then except for when i didn't pay my sister back $200 and i lost all electronic privileges for about 3 mo. - till i paid her back). my mom used a wooden spoon, a leather strap (and yes i had welts when she was done). i also had to write 1,000 times ';I will not.....'; and had extra chores, etc. but i do NOT consider it abuse. i deserved every single one of them (except for one when my bro got me in trouble when i didn't do anything, but he apologized and so did my mom). i knew my parents loved me, we cuddled all the time, they told me they loved me every chance they got, and i grew up happy and healthy. now, i'm 16, straight A COLLEGE STUDENT with a 4.48 GPA. not on drugs, never had alcohol. never had sex, never had a boyfriend, haven't had my first kiss. nor do i want one. i don't need a boyfriend. they just add pressure. i just recently got my first cell-phone and I pay for it. I appreciate how my parents raised me. i'm allowed to go out with my friends when i want (just as long as i let them know who, what, when, where, and why. but i have a curfew and make sure i stick with it so i won't lose that privilege), I'm a solid Christian, well-disciplined with a job, and my parents TRUST me. i don't mind them searching my computer or my room, because I DON'T HAVE ANYTHING TO HIDE. i know they love me and i will raise my kids the same.

    When I first heard of this I thought it was purely ridiculous, SPANKING always does a little good. I do consider that Child Abuse is extremely wrong, but a spanking is not child abuse.     Don't get your belly button or cartilage pierced. You will seriously regret it later on in life. When you wear shirts that cover your stomach like sweaters and stuff, sometimes the ring gets caught in the shirt and it can rip the belly ring out. You have to keep the piercing in for a little while. So...if you want to get a belly ring, I would wait until Summer. (:

    Sweetie I hate to be the bad person here but I have 13 piercings over my face and ears. Listen you want to talk your parents into it and you have to go with their answer. If you want to get it at a place that doesnt ask for consent Their garbage and you will probably get a backwoods screwed up infected piercing. It's against the law quite litterally. So try to convince mom or dad to help you out and work for it. I begged from 13 to 16 for a tongue piercing and mom said no. Thank god I would have regretted it immensly. I got my first piercing when I was 17 three weeks before my 18th birthday and It was good I waited till mom agreeed. Do your research know your piercing and everything that can go wrong and your statistics it will help your argument immensly

    Well st 18 you can do whatever you want but if you are a minor you can't. Without being enmancipated and being under 18 you will be taken back to your mother again, what you can do is call ';family services'; and ask for help, they evaluate your situation and maybe a to be placed at another home, maybe with another family member.

However, what you may not understand is that parents very much wish that their kids could learn from the parents' experience, rather than having to go through their own failures.     of course not. they do wish to keep their children healthy, wealthy and wise. this may not be what is actually in the child's best interest in the long run but the formative years are for parents to assert what they think is the best plan. after age 18 a child may effectively decide to do what they wish, as long as they also choose to accept no funds. if you take the money, you usually also have to take the advice.
    They don't.





    Generally parents want the best for their children, although it is not always seen like this by their children.





    Oh parents make mistakes ( they are only human) and some children will not forgive them for those mistakes, however little they may be and will continue the unforgiving nature for years, until they find themselves in a similar position with heir own children-then they realise their own parents difficulty.

    My cousins parents tried so hard to make her the smartest, prettiest, most responsible daughter ever. She went to college 2 years early, and halfway through her first year, she became out of control. She wasnt used to the freedom and option to make her own choices, and didnt have the skills to do things on her own, without being told. It eventually developed into her getting into a violent relationship with a man that dictated her every move...and due to the control over her at home, she thought that was normal. Since then I've 'adopted' her and shes getting back on track, but at 20 years old, she still isnt 'adult' enough to make basic decisions on her own.





    Not that I'm saying all cases are like that. Just one example of thousands.

    Unfortunately their options are very limited. Because their parents are illegal and are not able to legally work in the USA, they can not provide income information to the Department of Education so they can calculate your EFC.





    The only option that I see (and I'm not particularly important, you see) is for the student who IS legal to get a job and pay for school as you go. Find a community college that is inexpensive and pay as you go. Possibly working full time and going to school part time. Also I would talk to your parents and see if they can assist you with the cost since they are responsible for this situation.

    There is WAY more to education then homework. There was actually a study that proved that homework did nothing to improve our children's learning power.     I think some parents try so hard to do right by their kids, that they become overbearing and demanding, without realizing it.





    My cousins parents tried so hard to make her the smartest, prettiest, most responsible daughter ever. She went to college 2 years early, and halfway through her first year, she became out of control. She wasnt used to the freedom and option to make her own choices, and didnt have the skills to do things on her own, without being told. It eventually developed into her getting into a violent relationship with a man that dictated her every move...and due to the control over her at home, she thought that was normal. Since then I've 'adopted' her and shes getting back on track, but at 20 years old, she still isnt 'adult' enough to make basic decisions on her own.





    Not that I'm saying all cases are like that. Just one example of thousands.





    Edit: That came out sounding more negative then I had hoped. Basically what I was trying to say is that parents try to prevent their children from making the same mistakes they did, but sometimes you have to learn the biggest life lessons on your own. Hopefully that sounds better.

    Unfortunately their options are very limited. Because their parents are illegal and are not able to legally work in the USA, they can not provide income information to the Department of Education so they can calculate your EFC.





    The only option that I see (and I'm not particularly important, you see) is for the student who IS legal to get a job and pay for school as you go. Find a community college that is inexpensive and pay as you go. Possibly working full time and going to school part time. Also I would talk to your parents and see if they can assist you with the cost since they are responsible for this situation.

    Yes, I went to visit my bf in county jail when I was 17 by myself. He had to make the appointment for visitation and he had to know my birthdate.     I live in California. We have something called a Cal-Grant for California residents attending school in California. See if your state has something like that.

    There is WAY more to education then homework. There was actually a study that proved that homework did nothing to improve our children's learning power. It actually showed that it may be more damaging. If you feel that your son is not getting the education that he needs then find him a different school but complaining incessantly about something as silly as this is going to get him nowhere. If you really want to help him teach him more stuff at home AFTER school.
    You are the mother and if your child needs extra help in a specific area you should provide it. Parents can't just sit back and watch this process!     Is there an educational reason why you feel your child needs homework? From an educator's viewpoint, depending on the grade level as well as the functioning level of a special needs student, homework is not always beneficial. As the teacher, your son's educational needs are her responsibility. If she is not fulfilling her job as the educator than it is time to discuss educational goals with your son's team. I am going to assume he has an IEP or a some type of individual educational plan in place. It is your right, as a parent, to request a review of the plan. This can be done through your child's teacher or in your case through an administrator. If communication with the teacher is an issue there are ways to work this out. It does work both ways, though. If you are continuously calling the teacher and complaining or accusing than she is not going to be as receptive if you come in with the attitude that you want to work as part of the team educating your son. It is stressful to have a special needs child and there are many problems with the special education programs. There are, however, also resources for you, but you will probably have to do some research to find support groups or advocacy groups in your area.

    I care for my disabled 76 yr old father who has lost his leg due to diabetes and has dementia. I often get overwhelmed. He just got out of the hospital and now I have to give him IV meds (well the nurse starts it and I take it off and flush it)

    Yes, there is a whole bunch of us family dedicated, responsible people out there. My dad was first and now it's my mom to care for with the Alzheimer. She was never a mean person 'till this came to her. It is stressful but can be offset with talking about the fun stuff that happened years ago even if they do not remember......it's conversation about happy times no matter how many times we repeat it. Don't make yourself miserable doing this job, chill-out, it's just a duty to be performed as only to be expected....and we are not perfect so don't strive for that super level. There is one thing I have come to realize. 'We are born once and in diapers twice'. I've even had my parents laughing over this as it is now my turn to change theirs as they did for me. Arrange a little time for yourself and good luck to you.

    I took care of my mom since I was 5 years old. (hard to believe but true). The way I way I deal with the stress is keep a journal and write down the things that happen that day. I pray to God every day and tell Him how I feel and let Him help me. Draw close to God and he will draw close to you. Ask for help. There is nothing wrong with asking for help. I don't know your age or if you are married and have children. You can make taking care of dad a family matter. Take shifts. This allows time for ';Me Time';. Every one needs that! If not you will suffer burn out. I have a couple of times even when I was pregnant with triplets and had to go to the hospital to rest. Otherwise I would lose the babies!
    Find a support group and find out who the others use for respite care. You need a home health care worker too. Check the white pages for senior service's in your area.





    I take care of my grandmother, hubby with M.P.D. %26amp; two kids with Autism. I use respite care to go see a movie, get a hair cut or take a shower in peace! Also ask your friends and family for help too.
    I feel you. My mom and I took care of both my grandparents that had Alzheimer's. My grandma lived with us. It was a very stressful time for the whole family. The best thing to do is to make time for yourself and get away every now and than. It is so hard to care for these people and outside nurses cost a fortune. I swear my grandma went so crazy she would actually try to murder us in our sleep! Finally, when my son was a baby we had to put grandma chair in the corner and build a wooden gate just to make sure she didn't try to kill my newborn! My grandma was looking for him one day to cook him and was going to put him in the oven! NO JOKE! It is so sad to see your loved ones go insane. My grandma was the sweetest person I ever have known. If she would have seen how crazy she got... and knew she wanted to have her great- grandchild for dinner, she would have killed herself! Some days we laughed... most days we cried. My grandma never cussed until she went crazy...than she said words I didn't even know! One day she was screaming in the living room..';Help me, Help me they are going to kill me!'; The mail man heard it and called the cops...a few minutes later the cops came to the door with guns and sheilds. They understood after we explained she was crazy. Just get out go to a movie, dinner or shopping and don't be too hard on yourself. My mom now has a living will stating that my sister and I are not to ever care for her if she is not in her right mind. I know she is doing this out of love for us because she does not want to put my sis and I through it with her, so it is her way of freeing us from the guilt as not to have us be burdened with that kind of responsibility. I will do the same for my sons. Take care of yourself first, some communities have support groups for this.     Hi Sharron.. It took a while to find the answer I was looking for. This is taken from the Michigan Statutes. Sub section I tells you.





    The following factors to be considered, evaluated, and used by the court to determine what is in the ';best interests'; of the children when establishing a child custody order: (a) The love, affection, and other emotional ties existing between the parties involved and the child. (b) The capacity and disposition of the parties involved to give the child love, affection, and guidance and to continue the education and raising of the child in his or her religion or creed, if any. (c) The capacity and disposition of the parties involved to provide the child with food, clothing, medical care or other remedial care recognized and permitted under the laws of this state in place of medical care, and other material needs. (d) The length of time the child has lived in a stable, satisfactory environment, and the desirability of maintaining continuity. (e) The permanence, as a family unit, of the existing or proposed custodial home or homes. (f) The moral fitness of the parties involved. (g) The mental and physical health of the parties involved. (h) The home, school, and community record of the child. (i) The reasonable preference of the child, if the court considers the child to be of sufficient age to express preference. (j) The willingness and ability of each of the parties to facilitate and encourage a close and continuing parent-child relationship between the child and the other parent or the child and the parents. (k) Domestic violence, regardless of whether the violence was directed against or witnessed by the child.     I agree I think its 14. But going into court and trying to change the custody set up, is usally not granted by the tween simply wanting to live with the other parent. Usually changes in circumstances are what are factored and they may ask the tween if they have a preference, but they do not have to ask, or take that into account. Stability in their life is more important, next week the kid could want to move again, round and round and courts do not put up with that mentality or proceedings.
    In most states the age is 12 years old. but in most cases the court won't ask the child because the court doe's want to put pressure on a child. because the child loves both parents equally. Its the judges final decision. the court may decide who the child may live with.

    i'm separated and ask my twelve yr son if he wanted to live with me or the ';ex';. he chose to live with me. And my two daughters will live with the ';ex';so maybe just asking will do. but for most states it's 14 yrs.
    I think it varies by state. I live in Georgia and my step-son could decide to live with us when he was 14. I am not sure about other states, but any state official or lawyer should be able to tell you.

    The teacher/child relationship is more important. The child has little power in this relationship, so it needs to be solid. A preschooler in an unhappy situation regarding his/her teacher doesn't have the language or maturity to recognise and explain what's going on.

    I'm training to be an Early Years teacher so it's only my opinion, but I think the relationship between teacher/ child is much more important. Of course, you have to keep parents involved with their child's education and development but as a teacher of young children, you have to get to know them on, dare I say it, quite a personal level. You need to be aware of their likes and their dislikes, you have to observe them and know what they like doing and what they engage in and adjust your style of teaching to fit in with their style of learning, otherwise it's meaningless to them. I feel we need to involve parents and update them as much as possible as they want the best for their child and we definitely need to build up a GOOD relationship, but at the end of the day, it is purely professional. You wouldn't say things like, ';Oh, I absolutely adore your daughter, I just want to take her home with me!'; Or something similar, which isn't meant to be taken seriously and should be sweet and a bit of fun because we're professionals. However, the relationship between teacher and child is close and genuine and one of trust and honesty with the child.

    That is more of a punishment for little kids...teens you take away their cell, computer, tv, mp3 player, or most importantly...their car.Who has to stand in the corner as punishment from their parents?
    This punishment is great and works for any age. That is, provided they were raised well. If they were raised poorly, then they'll just talk back no matter what punishment you give.





    And example of this working even with teens was way back when, when I worked at summer camp as a councellor (when I was 17), I had campers who were 16, and I could make them go stand in the corner and they would do it and it would be so embarassing that they wouldn't commit the same crime again.

    i was never told to sit in the corner... my punishment was punching, kicking to the head....i'm surprised i sitll have teeth and not broken anything on my face.
    My thirteen year old daughter had to stand in the corner sometimes. She was still having temper tantrums at that age. She turned out just fine in the long run.

    You're not a kid anymore. Maybe they don't think you're so insecure that they need to prop you up with fluffy compliments. Most the time it is the parents that have a hard time adjusting to their kids becoming adults, but in your case it sounds like it's the other way around.





    Or, some people are good at criticizing and bad at complimenting. Maybe that's how your parents are.





    Also, you SHOULD be doing well for yourself, and in a selfish way! There is no other way to take care of yourself. Selfish means acting in your own self interest.
