Is it illegal to lie to the Funeral Director about deceased parent's marital status?

I believe that my brother lied about my father's marital status, to tie up the processing of death claim. If he is found out, will he go to jail?Is it illegal to lie to the Funeral Director about deceased parent's marital status?
I can't imagine this being illegal, unless he was trying to defraud the funeral director some way that I can't imagine.
